Promoter
MVE Pty Ltd ACN 083 539 128 trading as Niche Homes of 9 Penola Road, Mount Gambier SA (‘we’, ‘our’, ‘us’).
Promotional Period
Niche Home’s $20,000.00 giveaway promotion (the Promotion) commences at 12:00am ACST on 1 January 2023 and closes at 11:59pm ACST on 1 December 2023 (End Date).
Entry Restrictions
To be eligible to enter the Promotion, you must:
- be 18 years or older;
- reside in Australia; and
- accept and comply with these Terms and Conditions.
Entry Procedure
You will automatically receive one (1) free entry into the Promotion if, during the Promotional Period:
- you are the owner of land in South Australia (Land);
- you signed a ‘SA Building Contract for New Homes’ contract with us (Contract) to build a house on the Land;
- the Contract remains in place; and
- the cooling off period under section 36(3) of the Building Work Contractors Act 1995 (SA) has expired and you have not exercised your right to cool off before the End Date.
If you have signed a Contract with Niche Homes before 5 June 2023 but from 1 January 2023, you will be notified via email that you can opt out of the Promotion by written notification to Niche Homes prior to 1 December 2023.
Draw Details
The winner will be determined by a random draw conducted by a representative appointed by us at 9- Penola Road, Mount Gambier SA on 4 December 2023 at 12:00pm ACST. The winner will be notified by telephone and email within seven (7) days of the draw.
If we are unable to contact the winner by 4 February 2024 or the winner forfeits the prize, then a redraw will be conducted on 4 March 2024, in the same manner, at the same location and from the same pool of eligible entrants as the first draw.
Prize Details
The prize is a lump-sum payment of TWENTY THOUSAND DOLLARS ($20,000.00) which can be used towards your build with us (Prize).
Prize Restrictions
The prize is not transferable. You are limited to one (1) entry per Contract.
Prize Claim Details
We will pay the Prize to the winner via electronic funds transfer into a bank account nominated by the winner in writing. We will aim to transfer the funds to the winner within four (4) weeks of receiving the winner’s bank account details in writing.
Publication Details
The name and locality of the Prize winner will be published on the following platforms within 30 days of the draw:
- Our website: https://www.nichehomes.com.au/;
- Our Facebook page: www.facebook.com/nichehomesmtgambier/; and
- Our Instagram Account: www.instagram.com/nichehomes/?hl=en.
If you are the winner, you give us permission to publish your name and locality on each of these platforms.
The winner must participate in and cooperate with us in relation to all publicity activities relating to the Promotion, including, without limitation, being interviewed, photographed, filmed and recorded, and if the winner authorises us to use that content (Details) for promotional, marketing and publicity purposes.
Additional Terms and Conditions
We reserve the right to:
- confirm that your entry is valid;
- seek further clarification from you in relation to your entry and compliance with these Terms and Conditions;
- disqualify you if you:
- tamper with or benefit from any tampering with the entry process or with the operation of the Promotion;
- act in a disruptive manner or act with the intent or effect of annoying, abusing, threatening or harassing us, our related bodies corporate or their respective officers, employees, agents or contractors; or
- contravene these Terms and Conditions.
- Our decisions in relation to the Promotion, including your eligibility to enter the Promotion and the drawing process are final and we are not obliged to correspond with you in relation to these matters.
- We, our related bodies corporate and our/their respective officers, employees, agents and contractors are not responsible for:
- lost, illegible, misdirected, incomplete or damaged entries; or
- incorrect or inaccurate transcription of information, human error, technical malfunctions or delayed entries.
- To the extent permitted by law, we exclude all:
- liability to you for any loss, damage, claim or expense that you suffer or incur in connection with this Promotion and the Prize; and
- warranties, representations or guarantees (Warranties) regarding the Promotion and the Prize, including any Warranties which may have been made in the course of advertising or promoting the Promotion.
- You release us and our related bodies corporate from any liability, cost, damage or expense arising out of, or in connection with, the Promotion and the Prize and you indemnify us against all claims, costs, liabilities, losses and expenses which we incur or are liable for arising out of or in connection with your breach of these Terms and Conditions.
- By participating in this Promotion, you acknowledge and agree that we:
- will collect and use the Details in order to conduct the Promotion;
- may disclose the Details and your name and locality to our related bodies corporate, officers, employees, agents or contractors in order to conduct the Promotion; and
- may use the Details and your name for future promotional, marketing and publicity purposes unless otherwise directed by you in writing.
- In our absolute discretion we may opt to substitute the Prize for materials or services of the same value.
- If for any reason this Promotion is not capable of running as planned, and, we reserve the right in our sole discretion to cancel, terminate, modify or suspend the Promotion subject to regulatory approval.
- You are liable for any taxes, duties or other applicable charges that may be due and payable, for whatever reason, resulting from participating in the Promotion or receiving the Prize.
- Our employees (and the employees of our related bodies corporate) and our/their immediate family members are not eligible to enter the Promotion. This includes entities controlled by any of our employees; and/or any contractors engaged by us either generally or in the course of the Promotion.
